Article 1: Purpose and Scope of Application
These General Terms and Conditions of Sale (GTC) govern all purchases made on the LAYABELLE website. They apply to any customer, whether a natural or legal person, with the legal capacity to enter into a contract.
By placing an order, you unreservedly accept these GTS, which are governed by the laws of the State of New Mexico and the Uniform Commercial Code (NMSA §55-2-101 et seq.).
Article 2: Products and Availability
The products offered are displayed for informational purposes only and are subject to availability. LAYABELLE reserves the right to refuse any order, particularly in the event of:
Suspicion of fraud
Pricing or information errors
Excessive quantities of the same product
Violation of the terms and conditions
Product images are for illustrative purposes only. Minor variations in color, size, or design may occur without affecting the conformity of the product.
Article 3: Rates and Pricing Conditions
The rates displayed do not include New Mexico Gross Receipts Tax (GRT). GRT (base rate 4.875% + local taxes, approximately 7.62%) is automatically added to the order total based on your location.
Prices are subject to change at any time without notice. Promotions and discounts are valid for a limited time and do not apply retroactively to previous orders.
Prices for items on sale or special promotion are not subject to subsequent adjustment.
Article 4: Order Formation and Modification
4.1 Order Validation
The order is formed upon confirmation of acceptance by email from LAYABELLE, in accordance with Article 2-206 of the New Mexico Uniform Commercial Code. You will receive an initial order confirmation, followed by a second notification indicating that your product has been shipped.
4.2 Cancellation and Modification
You may cancel your order free of charge within 2 hours of the initial confirmation, before processing begins.
After this period, cancellation or modification will only be possible with the written consent of LAYABELLE and in accordance with the applicable conditions. Shipping and handling costs remain the responsibility of the seller.
4.3 Customer Information
You must provide accurate information regarding:
Your identity (first and last name)
Your complete and valid shipping address
Your email address and phone number
Your billing address (if different)
Your bank details (processed securely by our partners)
LAYABELLE shall not be liable for any errors or omissions made by the customer in this information.
Article 5: Delivery
5.1 Delivery Times
Products are shipped within a maximum of 48 hours after confirmation of your order.
Delivery is usually made within 5 to 9 business days (Monday to Friday), depending on your location and the mode of transport used.
These delivery times are provided for informational purposes only and do not constitute a strict obligation. In the event of a delay, LAYABELLE undertakes to inform you by email as soon as possible.
5.2 Tracking and Responsibility
A tracking number will be sent to you approximately 4 days after shipment via your confirmation email. You will be able to track your package in real time.
Important: Once the package is marked as Delivered by the carrier, responsibility and risk of loss are transferred to the customer, in accordance with Article 2-509 of the Uniform Commercial Code.
LAYABELLE cannot be held responsible for:
Loss or theft after delivery
Packages not received despite confirmation of delivery
Damage incurred in transit (except in cases of carrier negligence)
5.3 Non-Receipt
If your package is marked as delivered but not received, please proceed as follows:
Check the address: Confirm the accuracy of the delivery address provided at the time of order.
Search for the package: Inspect your porch, mailbox, garage, or nearby areas (bushes, backyard).
Ask your neighbors: Ask members of your household, neighbors, or building manager if the package was accepted in your absence.
Contact the carrier: Contact the carrier (USPS, FedEx, UPS, Royal Mail, Evri, etc.) directly with your tracking number to obtain specific details.
File a claim: If the package is still missing, the carrier may offer compensation. Consult the carrier's terms and conditions for this process.
5.4 Undeliverable Address
It is the customer's responsibility to provide an accurate and deliverable address. LAYABELLE will not be responsible for non-delivery due to an incomplete, inaccurate, or undeliverable address.
In the event of an undeliverable address, all return shipping costs will be the responsibility of the customer.
If you identify an address error after placing your order, you must notify LAYABELLE within a maximum of 2 hours after order confirmation, at contact@layabelle.com.
Article 6: Payments and Security
6.1 Payment Methods
Payments are made securely through our partners:
Stripe (credit cards: Visa, MasterCard, American Express, Discover)
PayPal (encrypted transactions)
No banking information is stored on our servers. Transactions are processed via SSL (Secure Socket Layer) to ensure the confidentiality of your data.
6.2 Payment Collection
Payment is collected when you confirm your delivery address at the time of payment. Your order is validated upon receipt of payment by the bank.
In the event of payment refusal (fraud detected, insufficient funds), your order will be automatically canceled.
6.3 Taxes and Charges
You are responsible for any taxes, customs duties, and additional charges related to importation. LAYABELLE is not responsible for:
Customs fees
Import taxes
Customs clearance fees
For international deliveries, we recommend that you check your country's customs regulations.
Article 7: Warranties and Compliance
7.1 Legal Warranty of Compliance
In accordance with the Magnuson-Moss Warranty Act (15 U.S.C. §2301) and Article 2-314 of the New Mexico Uniform Commercial Code, all products must comply with their description and be free from defects.
A product is considered defective if:
It does not match the description provided.
It has hidden defects.
It is not fit for the purpose for which it could reasonably be expected to be used.
7.2 Claim Period
Defects must be reported within 30 days of receipt of the product. For hidden defects, you have a reasonable period of time to identify them.
Any claims made after this period cannot be processed for compliance.
7.3 Warranty Exclusions
The warranty does not cover:
Normal wear and tear of the product
Damage caused by misuse
Modifications or repairs made by the customer
Items purchased on sale or as part of a special promotion (unless there is an apparent defect)
Personalized products
Article 8: Returns and Refunds
8.1 Return Policy
We offer a 30-day return policy from the date of receipt of the product for non-defective items.
The return conditions are as follows:
Item must be undamaged and in its original condition
Original packaging must be intact
Accessories and documentation must be included
Proof of purchase (order email)
8.2 Return Shipping Costs
You are responsible for return shipping costs, except in cases of non-compliance or error on our part.
For defective products, LAYABELLE will reimburse return shipping costs upon presentation of proof (photos, video, carrier report).
8.3 Return Exclusions
The following items cannot be returned:
Sale or clearance items (except for defects)
Personalized or custom-made items
Digital or downloaded items
Products whose packaging has been opened (certain electronic items)
8.4 Refunds
Refunds are processed in accordance with the FTC Mail, Internet, or Telephone Order Merchandise Rule and are issued within 7 business days of receipt and inspection of the returned product.
Refunds are made using the same payment method used for the original order. Original shipping charges are not refunded, except in cases of error on our part.
Article 9: Liability and Limitation of Damages
9.1 Limitation of Liability
The liability of LAYABELLE is strictly limited to direct and foreseeable damages. Under no circumstances shall LAYABELLE be liable for:
Indirect or consequential damages
Loss of revenue or profits
Damage to reputation
Business interruptions
Product replacement costs
9.2 Force Majeure
LAYABELLE shall not be liable for delays or failures due to circumstances beyond its control, including:
Natural disasters
Strikes
Logistical problems with suppliers
Power failures
Government restrictions
In accordance with Section 2-615 of the Uniform Commercial Code, the seller is released from its obligations in the event of an unforeseeable event.
Article 10: Personal Data Protection
LAYABELLE collects and processes your personal data (name, address, email, payment information) exclusively for:
Processing your order
Delivery tracking
Commercial communications (with consent)
Legal and tax compliance
In accordance with federal data protection laws and the New Mexico Data Privacy Act, you have the right to:
Access your data
Correct inaccurate data
Request the deletion of your data
Object to processing

Article 11: Right of Withdrawal and Satisfaction Guarantee
For customers residing in states where the right of withdrawal applies legally, you have a period of 14 days from receipt to exercise this right, free of charge (except for return shipping costs).
The right of withdrawal does not apply to:
Personalized items
Digital products
Items on sale
Article 12: Intellectual Property
All content on the website (images, text, logos, designs) is protected by the Lanham Act and remains the exclusive property of P2M DIGITAL LLC.
You are not authorized to:
Reproduce or copy product images
Use descriptions for commercial purposes
Create copies or imitations of products
Any violation will result in legal action.
Article 13: Account Suspension
LAYABELLE reserves the right to suspend or close any customer account in the event of:
Fraudulent use
Failure to comply with the T&Cs
Repeated chargebacks or disputes
Abusive behavior
Article 14: Dispute Resolution and Applicable Law
14.1 Applicable Law
These Terms and Conditions are governed by the laws of the State of New Mexico, including the Uniform Commercial Code (NMSA §55-1-101 et seq.).
14.2 Jurisdiction
Any dispute relating to the Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Curry County, State of New Mexico, or arbitration by mutual agreement.
14.3 Arbitration
For any dispute exceeding $10,000, the parties agree to arbitration in accordance with the rules of the American Arbitration Association (AAA). The cost of arbitration shall be borne by the seller.
14.4 Class Action Waiver
By accepting these Terms and Conditions, you waive the right to bring a class action or collective action against LAYABELLE.
Article 15: Modification of Terms and Conditions
LAYABELLE reserves the right to modify these Terms and Conditions at any time. Modifications shall take effect immediately upon publication on the website.
Your continued use of the site implies acceptance of the changes.
